By engaging Bankk's services or using any of our digital products, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using our services.
2. Services Description
Bankk provides comprehensive full-stack development services, including but not limited to:
- Modern full-stack web application development using React, Next.js, and related technologies
- Frontend development with a focus on responsive and performant user interfaces
- Figma to code conversion, ensuring pixel-perfect implementations
- Custom API development and integration
- Database design and implementation using various technologies (e.g., SQL, NoSQL)
- Blockchain and Web3 development services
- Automation scripts and tools development
- Performance optimization and scalability solutions
3. Project Engagement and Delivery
- Project scopes, timelines, and deliverables will be clearly defined and agreed upon before the commencement of any work.
- Bankk reserves the right to adjust project timelines based on complexity, client responsiveness, and unforeseen technical challenges.
- Clients are responsible for providing necessary access, content, and feedback in a timely manner to ensure project progress.
- Regular project updates and communication will be provided through agreed-upon channels.
- Any changes to the project scope may result in timeline and cost adjustments, which will be communicated and agreed upon before implementation.
4. Intellectual Property
Upon full payment for services rendered, clients will receive full intellectual property rights to the custom code and designs created specifically for their project. However, Bankk retains the right to:
- Reuse and repurpose general coding techniques, algorithms, and non-proprietary components developed during the project.
- Display the work in Bankk's portfolio, unless explicitly agreed otherwise in writing.
- Retain and use any knowledge or expertise gained during the project for future developments.
Clients are responsible for ensuring they have the necessary rights to any assets, content, or third-party services they provide for use in the project.
5. Payment and Billing
- Payment terms, including amounts and schedules, will be specified in the project agreement or invoice.
- For subscription-based services, payments will be processed automatically via Stripe on the agreed-upon billing cycle.
- Bankk reserves the right to suspend services for overdue payments after providing reasonable notice.
- All quoted prices are exclusive of any applicable taxes, which will be added to the final invoice.
- For long-term projects, Bankk may require a deposit or implement a milestone-based payment structure.
6. Termination
Bankk reserves the right to terminate services immediately, without prior notice, for any breach of these Terms, including but not limited to:
- Non-payment or consistent late payments
- Unethical client behavior or requests
- Violation of any applicable laws or regulations
- Misuse of Bankk's services or intellectual property
Upon termination, clients are required to cease use of any services or products provided by Bankk and settle any outstanding payments.
7. Limitation of Liability
Bankk's liability is strictly limited to the amount paid for the services rendered. We explicitly disclaim responsibility for:
- Any consequential damages or lost profits resulting from the use of our services or products
- Issues arising from client-provided content, assets, or third-party services
- Downtime or performance issues of third-party hosting or service providers
- Any damages resulting from unauthorized access to client accounts or data
Clients are advised to maintain appropriate backups and security measures for their data and systems.
8. Changes to Terms
Bankk reserves the right to modify these Terms of Service at any time. Significant changes will be communicated to active clients through email or prominent notices on our website. Continued use of our services after such modifications constitutes acceptance of the updated terms.
